The chairman of the Osun State Basic Education Board (SUBEB), Mr Ibukun Fadipe, has filed a N700 million lawsuit against the Osun State chapter of the All Progressives Congress and its spokesperson, Mr Kola Olabisi over alleged libellous publications.
Fadipe in the suit HIL/33/26 filed by his counsel, Oluwaseun Ajoba, on March 27 at the Ilesa High Court, said the APC and its spokesperson, falsely accused him of involvement in the death of late Chief Raheem Ade Komolafe.
He said the defendants circulated the “false” allegations to the public despite the fact that he had been exonerated of the allegations.
The Accord Party chieftain sought a declaration that the publications made by the defendants, whether
on social media or by way of a press release, is false, malicious, and
constitutes a libel against the Claimant.
Fadipe also asked for a declaration that the defendants in publishing the said libellous
statements, violated his right to dignity of the human person as
guaranteed by Section 34 of the Constitution of the Federal Republic of
Nigeria 1999 (as amended).
The SUBEB boss asked for the sum of N50 million
being general damages for the grievous, malicious, and widespread libel of
the claimant.”
He also asked for the sum of “One hundred million naira being aggravated damages, awarded to reflect the exceptional injury caused to the claimant by reason of the defendants’ deliberate, malicious, and politically orchestrated conduct.”
“The sum of N100,000,000.00
being exemplary damages, to mark this Honourable Court’s unequivocal
condemnation of the defendants’ cynical exploitation of serious criminal falsehoods for partisan political gain.”

Fadipe sought an order of mandatory injunction compelling the
defendants, jointly and severally, to forthwith take down, delete, and
permanently remove all libellous publications from every social media
platform, account, handle, and digital medium within their custody or
control.
“An order of perpetual injunction restraining the
Defendants, whether by themselves, their servants, agents, privies, social media managers, spokespersons, or any person acting on their behalf or instruction, from publishing or causing to be published any further statement, post, press release, statement, broadcast, or communication
falsely alleging or insinuating that the claimant bears any criminal responsibility for the death of the late chief Raheem Ade Komolafe.”
He also asked the court to order the defendants to retract the publications and issue a public apology in two national newspapers within 14 days of its order.
Fadipe sought an order of payment of N10 million as cost of and “incidental to this action on a full indemnity basis, having regard to the deliberate and wholly unjustifiable nature of the defendants’ conduct.”
